Can I get unemployment if I failed a drug test but have a medical marijuana card?

So an accident happened at work and I had to take a drug test. I failed. Can I still get unemployment if I have a CA medical marijuana card? If my ex employer doesn't fight it will EDD deny my claim. Who's decision is it ultimately up to? When I got fired the HR lady said that I should still file and that I should be able to receive benefits and that it was up to their discretion.
